Terms and conditions

These terms govern your use of motodealers.co.uk. They apply to everyone – whether you are browsing, selling a bike or running a dealer account. By using the site you accept them.

1. Who we are

MotoDealers UK is a trading name of Code Smart Web Limited (“we”, “us”), a company registered in England and Wales under company number 16546933. Our registered office is Strawberry Fields Digital Hub, Euxton Lane, Chorley PR7 1PS, United Kingdom. You can reach us at [email protected] or through our contact form.

2. What MotoDealers UK is – and what it is not

We are an advertising platform. We list motorcycles and scooters offered by private sellers and by dealers, and we pass buyer enquiries to them. We are not a party to any sale. We do not own, inspect, store or deliver the vehicles advertised, we do not hold buyers’ money and we do not act as an agent or broker for either side. Any contract of sale is between the buyer and the seller.

3. Your account

You must be at least 18 to create an account. Keep your password to yourself; you are responsible for everything done through your account. Tell us immediately if you suspect someone else has access to it. You can close your account at any time from your account settings or by emailing us.

4. Terms for sellers

4.1 Private sellers and dealers

Free private advertising is for UK private sellers only. If you sell motorcycles in the course of a business you must register a dealer account, and every advert must make it clear that it comes from a trader. Posting trade stock through a private account is a breach of these terms and we may remove the adverts without notice.

4.2 Placing an advert

Complete every field truthfully and to the best of your knowledge. We are not responsible for incorrect information supplied by an advertiser. A private advert runs free for 4 weeks; after that we ask you to confirm it is still available and renew it for another free 4 weeks, as many times as you need.

We may correct obvious formatting and spelling issues, and we may refuse or withdraw any advert that breaches these terms, without giving reasons.

4.3 What you promise about your advert

By posting an advert you confirm that:

  • the information is truthful and complete, including any known faults, damage, category write-off or outstanding finance;
  • you own the vehicle or have the owner’s permission to sell it;
  • the description and photographs are yours to use, and show the actual vehicle for sale;
  • you will not include links to other websites, or contact details designed to take the transaction off the site;
  • you will not post content that is offensive, discriminatory, misleading or unlawful;
  • you will comply with UK consumer law, including the Consumer Rights Act 2015 if you sell as a trader.

You keep the copyright in your photographs and text. By uploading them you grant us a non-exclusive, royalty-free licence to display, resize and reproduce them on the site and in our marketing of the site, for as long as the advert is live and in our archive afterwards.

4.4 Booster packages and payment

Any free advert can be promoted by buying one of our booster packages. Payment is taken on the Stripe payment gateway; we never see or store card numbers, expiry dates or CVV codes and only receive the payment status. Booster fees are shown before you pay and include VAT where applicable.

Because a booster starts immediately, you agree that the service begins at once and that your statutory 14-day right to cancel a digital service is lost once it has started. If we withdraw your advert for a breach of these terms, no refund is due. If we withdraw it for any other reason we will refund the unused part of the booster.

5. Terms for buyers

Adverts are supplied by third parties. We check what we reasonably can, but we cannot guarantee that an advert is accurate, that the vehicle is as described or that the seller is who they say they are. Before you buy:

  • view the bike in person and at the seller’s stated address, in daylight;
  • check the V5C, the VIN and the frame number against the documents;
  • run an HPI or equivalent check for outstanding finance, theft and write-off markers;
  • never send a deposit or full payment to someone you have not met, and be wary of any seller who cannot meet you;
  • treat prices well below the market as a warning sign, not a bargain.

If you buy from a dealer you have the protection of UK consumer law. If you buy privately, the bike must match its description but you have far fewer rights – inspect carefully.

Please report a suspicious advert to [email protected] so we can investigate and remove it.

6. Using the site

You may not scrape, crawl or copy our listings in bulk, resell our content, attempt to gain unauthorised access to any part of the service, or send unsolicited marketing through our enquiry forms. Automated access is allowed only for search engines respecting our robots.txt.

Everything on the site other than user-supplied adverts – the design, code, database, logos and the MotoDealers name – belongs to us or our licensors.

7. Availability and our liability

We work to keep the site available but we do not promise it will be uninterrupted or error-free, and we may change or withdraw features.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, we are not liable for any loss arising from a transaction between a buyer and a seller, from an inaccurate advert, or for indirect or consequential loss. Where we are liable, our total liability to you is limited to the amount you paid us in the 12 months before the claim, or £100 if you paid us nothing.

If you use the site as a consumer, your statutory rights are unaffected.

8. Suspension and termination

We may suspend or close an account, and remove adverts, if these terms are breached, if we are asked to by a competent authority, or if we reasonably suspect fraud. Where it is fair to do so we will tell you why and give you a chance to put it right.

9. Your data

How we handle personal data is set out in our privacy policy and our cookie policy, which form part of these terms.

10. Changes to these terms

We may update these terms as the service changes. The date at the top shows the current version. If a change materially affects you we will give reasonable notice; continuing to use the site after that means you accept the new terms.

11. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you live in Scotland or Northern Ireland you may also bring proceedings in your local courts.
